These Terms of Service govern your use of the Herman Cybersecurity & Technology Services website, consultation process, client communications, and services. By accessing this website, submitting an inquiry, booking a consultation, or engaging our services, you agree to these Terms.

1. Services Provided

Herman Cybersecurity & Technology Services provides cybersecurity, technology consulting, digital privacy, risk reduction, technology evaluation, process improvement, training, and related advisory services for individuals, families, and small businesses.

Services may include assessments, recommendations, reports, action plans, implementation guidance, training, and other deliverables based on the agreed scope of work.

Unless specifically stated in writing, services are advisory and educational in nature. We do not guarantee that any system, account, device, business process, website, or technology environment will become fully secure, compliant, error-free, or protected from all threats.

2. No Guarantee of Results

While we pride ourselves on the results realized by our clients, cybersecurity and technology risk cannot be eliminated completely. While our services are designed to help clients make informed decisions, reduce risk, and improve technology use, we cannot 100% guarantee specific outcomes, business results, security results, compliance status, financial savings, or prevention of unauthorized access, fraud, scams, malware, data loss, or other incidents.

You remain responsible for deciding whether and how to implement any recommendations provided.

3. Not Legal, Financial, Insurance, or Tax Advice

Herman Cybersecurity & Technology Services does not provide legal, financial, insurance, accounting, or tax advice.

Any discussion of compliance, privacy, cybersecurity requirements, contracts, insurance, fraud prevention, payment processes, or business risk is provided for general technology and cybersecurity guidance only. You should consult qualified legal, financial, insurance, tax, or other professional advisors for advice specific to your situation.

4. Client Responsibilities

Clients are responsible for providing accurate, complete, and timely information needed to perform the agreed services.

Clients are also responsible for:

  • Maintaining lawful access to any accounts, systems, devices, websites, or data discussed or reviewed

  • Making final decisions about technology, cybersecurity, privacy, business, or operational changes

  • Backing up important data before making changes to systems, devices, accounts, or configurations

  • Reviewing recommendations carefully before implementation

  • Securing passwords, recovery codes, account credentials, and sensitive information

  • Complying with applicable laws, contracts, employer policies, vendor terms, and regulatory obligations

You agree not to request or authorize work involving systems, accounts, devices, networks, or data that you do not own or have permission to access.

5. Sensitive Information and Credentials

Please do not submit passwords, security codes, financial account numbers, Social Security numbers, confidential business data, medical information, or other highly sensitive information through website forms, booking forms, standard email, or other general communication channels.

If sensitive information is needed for a specific engagement, we will discuss an appropriate handling method before it is shared.

Herman Cybersecurity & Technology Services will never ask for your password in a general website form.

6. Scope of Work

Each paid engagement may be governed by a written proposal, statement of work, invoice, engagement summary, or other written communication describing the expected scope, deliverables, timing, pricing, and assumptions.

Any work outside the agreed scope may require additional approval, revised pricing, or a separate engagement.

7. Consultations

Free consultations are intended to determine whether Herman Cybersecurity & Technology Services is a good fit for your needs and to identify appropriate next steps.

A free consultation does not create an ongoing client relationship unless a paid engagement is accepted or otherwise confirmed in writing.

8. Fees, Payments, and Invoicing

Fees may vary based on the type of service, scope of work, number of accounts or devices, business complexity, urgency, implementation support, and other factors.

Payment terms will be provided in the applicable invoice, proposal, booking page, statement of work, or written agreement.

Unless otherwise stated in writing:

  • Individual services may require payment before work begins

  • Small business engagements may require a deposit, milestone payments, or payment before final deliverables are released

  • Invoices are due according to the payment terms stated on the invoice

  • Late or unpaid invoices may result in delayed work, paused services, or cancellation of the engagement

Accepted payment methods may include bank transfer, Zelle, check, card payment, or other approved payment methods. Available payment methods may vary by engagement.

9. Cancellations and Rescheduling

Clients should provide reasonable notice if they need to cancel or reschedule a consultation, meeting, or service session.

Repeated cancellations, missed appointments, or failure to provide required information may result in rescheduling delays, additional fees, or termination of the engagement.

For paid engagements, cancellation and refund terms may vary based on the service type, work already performed, and deliverables already prepared.

10. Refunds

Refunds are handled on a case-by-case basis unless a specific refund policy is stated in writing for a particular service.

Because many services involve time, analysis, preparation, research, custom recommendations, or other professional work, fees may be non-refundable once work has begun.

If you are dissatisfied with a service, contact Herman Cybersecurity & Technology Services so the issue can be reviewed.

11. Third-Party Tools, Platforms, and Services

Our services may involve discussion, evaluation, configuration guidance, or use of third-party tools, platforms, software, hardware, websites, payment processors, cloud services, AI tools, security tools, or other vendors.

Herman Cybersecurity & Technology Services does not control third-party services and is not responsible for their availability, security, privacy practices, pricing, terms, performance, outages, data handling, or changes.

You are responsible for reviewing and accepting any applicable third-party terms, policies, subscriptions, licenses, or fees.

12. AI Solution Use

Herman Cybersecurity & Technology Services may use artificial intelligence tools to support internal business activities, such as organizing non-sensitive notes, drafting general materials, summarizing non-sensitive information, improving templates, or supporting research and productivity.

We do not intentionally input passwords, financial account information, payment card information, Social Security numbers, highly sensitive personal information, confidential business data, or other sensitive client information into AI tools.

AI tools may assist the work process, but they do not replace professional judgment. Client-facing deliverables are reviewed before being provided.

13. Website Information

Information on this website is provided for general informational purposes only. Website content may discuss cybersecurity, privacy, technology, business processes, or related topics, but it should not be treated as professional advice for your specific circumstances unless provided as part of a paid engagement.

We may update, remove, or modify website content at any time without notice.

14. Client Community

Herman Cybersecurity & Technology Services may offer an optional Client Community or related communications for current and former clients.

Participation is voluntary. Members may receive updates, resources, event invitations, or other content related to technology, cybersecurity, privacy, and business improvement.

Clients may opt out of optional communications or community participation at any time.

Any success story, testimonial, public-facing quote, or identifying client reference will only be shared with permission. The FTC provides endorsement guidance for testimonials and endorsements, so testimonials should be truthful, not misleading, and used with appropriate consent.

15. Intellectual Property

Website content, service materials, reports, templates, frameworks, checklists, written recommendations, graphics, branding, and other materials created by Herman Cybersecurity & Technology Services are owned by Herman Cybersecurity & Technology Services unless otherwise stated in writing.

Clients may use deliverables provided to them for their own personal or internal business purposes. Clients may not resell, redistribute, publish, copy, modify, or commercially exploit service materials without written permission.

16. Confidentiality

Herman Cybersecurity & Technology Services will take reasonable steps to treat non-public client information as confidential.

However, confidentiality obligations do not apply to information that:

  • Is already public

  • Was known before being provided

  • Is independently developed without use of confidential information

  • Is received lawfully from another source

  • Must be disclosed by law, court order, legal process, or government request

  • Must be disclosed to protect rights, safety, security, systems, clients, or business operations

A separate written confidentiality or nondisclosure agreement may be used for certain business engagements.

17. Privacy

Your use of the website and services is also governed by the Herman Cybersecurity & Technology Services Privacy Policy.

The Privacy Policy explains what information may be collected, how it may be used, how AI solutions may be used, and how clients can request access, correction, deletion, or other actions regarding their data. California’s Attorney General describes CCPA rights such as access, deletion, opt-out, and non-discrimination, and your privacy policy can voluntarily offer a clear request path even if the business does not meet statutory thresholds.

18. Acceptable Use

You agree not to use this website, forms, booking tools, communications, services, or deliverables to:

  • Violate any law, regulation, contract, or third-party right

  • Request unauthorized access to systems, accounts, devices, networks, or data

  • Commit fraud, harassment, abuse, impersonation, or unlawful activity

  • Submit malware, malicious links, exploit code, stolen data, or unauthorized credentials

  • Interfere with the website, business systems, communications, or service delivery

  • Misrepresent your identity, authority, ownership, or authorization

We may refuse, suspend, or terminate service if we believe a request is unlawful, unsafe, unethical, outside our scope, or inconsistent with these Terms.

19. Limitation of Liability

To the maximum extent permitted by law, Herman Cybersecurity & Technology Services will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, business interruption, reputational harm, loss of goodwill, security incidents, unauthorized access, fraud, scams, or third-party service failures.

To the maximum extent permitted by law, the total liability of Herman Cybersecurity & Technology Services for any claim related to the website, services, deliverables, or these Terms will not exceed the amount paid by the client for the specific service giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

20. Indemnification

You agree to indemnify and hold harmless Herman Cybersecurity & Technology Services from claims, damages, losses, liabilities, costs, or expenses arising from your misuse of the website or services, your violation of these Terms, your violation of law, your unauthorized access to systems or data, or information you provide that is inaccurate, unlawful, or unauthorized.

21. Right to Refuse or Terminate Service

Herman Cybersecurity & Technology Services may refuse, pause, or terminate services if:

  • The requested work is outside scope

  • The request appears unlawful, unethical, unsafe, or unauthorized

  • Required information is not provided

  • Payment is not received

  • The client engages in abusive, threatening, fraudulent, or inappropriate behavior

  • Continuing the engagement would create unreasonable risk

If an engagement is terminated, any amounts owed for work already performed may remain due.

22. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.

Any disputes related to these Terms, the website, or services will be handled in the state or federal courts located in Colorado, unless another dispute-resolution process is agreed in writing.

23. Changes to These Terms

Herman Cybersecurity & Technology Services may update these Terms from time to time. Updated Terms will be posted on this page with a revised effective date.

Your continued use of the website or services after updates are posted means you accept the revised Terms.
